themeaningofadirectiveofconduct,amongwhichdirectivesconsideredlegallybind-
ingareparticularlyimportantforlawyers.Ontheotherhand,thedescriptiveprinciples
servetodetermineaspecificmethodofcreatingaparticularlegalconstruct.
Inacademicworksrelatingtolabourlawtherehasbeenastronginterestintheprin-
ciplesoflaw.Itwascausedbydifferentfactorsindifferentperiods.Atfirst,themost
importantwereundoubtedlytheideologicalaspectsandthepursuitofemancipation
oflabourlaw,attemptstoemphasizeitsindependence,inparticularfromcivillaw
inwhichlabourlawhasitsorigins.Intheconceptadoptedbythelegislature,thelabour
lawprincipleshaveplayedanimportantrole.AccordingtoArticleXII§3ofthepro-
visionsimplementingtheCivilCode,17theseprinciplesdefinedthescopeofsubsidiary
applicationoftheCivilCodeinemploymentrelations(theprovisionscouldnotbe
contrarytotheprinciplesoflabourlaw).ThepresumptionthattheCivilCodeshould
notviolatethelabourlawlegislationexplicitlyconfirmedthedistinctionbetween
thebranchesoflabourlawandcivillaw.
Althoughtheprocessofemancipationoflabourlawfromcivillawcouldbeconsidered
completeuponenactmentoftheCivilCodewhenthemutualrelationsbetweenthese
twobranchesweredeterminedinaquiteunequivocalmanner,itwasoftenconsidered
thatthecodificationoflabourlawshouldbecomplimentarytothisprocess.Inthedis-
courseontheneedforcodificationitwasemphasized,amongothers,thatitcouldbe
anopportunitytoclarifylabourlawand,mostimportantly,toputastrongerempha-
sisonitsindependenceasabranchoflaw.Theideatocreateaseparategeneralpart
ofthecodeplayedamajorrole.Oneoftheimportantissuesunderdiscussionwasthat
relatingtotheprinciplesoflabourlaw.Aboveall,itwasconsideredwhetherthegeneral
provisionsshouldincludeacatalogueoftheseprinciplesandwhatthepossiblecontents
ofsuchcatalogueshouldbe.Theviewontheneedtoincludethecatalogueoftheprin-
ciplesoflabourlawintheCodewasquitepopular.Itwasgenerallyagreedthat,on
theonehand,suchcataloguecouldnotbeexhaustiveand,ontheotherhand,thatthese
principlesshouldbenormative.Theviewsconcerningtherankandtheimportance
oftheprinciplesoflabourlaw,presentedduringtheperiodprecedingtheenactment
oftheLabourCode,weretoalargeextentreflectedintheactadoptedin1974.Above
all,asectionoftheCodedefininggeneralprovisionsincludedachapteronthegeneral
principlesoflabourlaw.Atthesametime,Article300oftheLabourCoderepeated,
withminorchanges,theprovisionsofArticleXII§3oftheActontheimplementation
oftheCivilCodeandprovidedthatinmattersnotregulatedbytheprovisionsoflabour
lawtheprovisionsoftheCivilCodeshallapplyrespectivelytotheemploymentrela-
tionshipifnotcontrarytotheprinciplesoflabourlaw.
