withtheConstitution.Theprinciplesessentialforthelabourlawrelationshipswhich
areincludedintheConstitutionarepublic-lawprinciples.
Certainly,theinternationallawsandEUlawsarealsoofrelevanceforreconstruction
oftheprinciplesoflabourlaw.Therefore,thereareprinciplesoftheinternationalla-
bourlawandtheprinciplesoflabourlawoftheEuropeanUnion.Recently,theyhave
beenincreasinglyimportantandaffectedtheinternallegalsystem.Inthatregard,at-
tentionshouldbegiventotheILO’sDeclarationonFundamentalPrinciplesandRights
atWorkadoptedinJune1998.Therelevantconventions,calledufundamental”(nos.29,
87,98,100,105,111,138,182),wereratifiedbyPolandandthusbecamepartofthePol-
ishlegalsystem.ThesameappliestotheEuropeanSocialCharterof1961asregards
provisionslistedintheratificationactandbindinguponPoland.Asregardslabour
lawoftheEuropeanUnion,provisionsofitsCharterofFundamentalRights(OJC303
of14.12.2007,p.1)mustalsobementioned.Theprovisionsofsignificantimportance
areincludedindifferentpartsoftheCharter,inparticular,inthechaptersregarding
equalityandsolidarity.
Anothercategoryoftheprinciplesoflabourlawarethosebasedonthelabourlegisla-
tion.TheLabourCodeisparticularlyimportant.Aboveall,itspecifiesthefundamental
principlesoflabourlaw.Mostofthemarerepetitions,withcertainmodifications(not
alwaysequaltoextensionandclarificationofconstitutionalnorms),oftheprinciplesal-
readyexpressedintheConstitutionoftheRepublicofPoland,intheinternationallegal
orderortheEUlaws,whichmayraisedoubtsastotheappropriatenessofsuchmethod
ofregulation.Theydonotexhaustalltheprincipleswhicharebasedonthislegalact.
Attentionshouldbegivenalsototheprinciplesdevelopedbyscholarsandcase-lawon
thebasisofotherprovisionsoftheCodeordeducedinquasi-logicalreasoning.Apart
fromtheLabourCode,theprinciplesaredistinguishedalsoinotherlabourlawlegi-
slation.Forobviousreasons,theyhaveanarrowerimpactandarelimitedtothelegal
relationstowhichtheseactsrelate(forexample,proceduralemploymentrelationships,
righttoemployment,unemploymentorcollectivelabourlaw).
Anothercriterionofsystematisationofthelabourlawprinciplesistheirimpact.Inthis
sense,thefirstissuetobeaddressedshouldbedistinguishinginter-branchprinciples
whicharerelevantnotonlyforlabourlaw.Asmentionedabove,thisisindeedthecase
withmostoftheprinciplesdefinedintheConstitutionoftheRepublicofPoland(for
example,theprincipleofrespectforhumandignity).Thesecondgroupareprinciples
relevantonlyfortheareasgovernedbylabourlawasaseparatebranchoflaw.These
includeprimarilytheprincipleswhich,becauseoftheirstatusandinparticularbe-
causeofthefactthattheyarecharacteristic(specific)ofthispartofthelegalsystem
only,arecalleduprinciplesoflabourlaw”or-accordingtothelegislature-ufunda-
mentalprinciplesoflabourlaw”.Bearingthisinmind,onecannotbutsaythatthey
arenotnecessarilyequallyimportantfordifferentlegalrelationsgovernedbylabour
law.Someofthemrefermainlyorexclusivelytoindividualemploymentrelationships
